Terms of Service

1. Agreement

These terms are an agreement between you and QWOX LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, New Mexico 87110, USA. By creating an account or using Qwox you accept them and our Privacy Policy. If you do not agree, do not use Qwox.

2. Who can use Qwox

You must be at least 16 and able to make a binding agreement. If you use Qwox for an organization, you confirm you may accept these terms for it.

3. Your account

You sign in with an email code or Google. Keep access to that email safe and tell us at hey@qwox.ai if you think someone else used your account. You are responsible for activity in your account.

4. Your content

What you write, send or create in Qwox stays yours. You give us a limited licence to store, process, copy and show it to you, and to send it to the service providers in our Privacy Policy, only to run Qwox for you. The licence ends when you delete the content or your account, except for backups that expire within 30 days.

You confirm you have the right to store the content you add, including information about other people.

5. Acceptable use

Do not use Qwox to:

• break the law or other people’s rights, including privacy and intellectual property;
• store data you have no right to keep, or special-category data about others without a legal basis;
• attack, overload, scrape or reverse-engineer the service, or get around its limits;
• use the assistant to create harmful, abusive or deceptive material.

6. The assistant

Qwox uses AI to organize your notes and answer from your records. It can make mistakes; check what matters before you rely on it. Qwox does not give legal, medical, financial or other professional advice, and it does not act outside the app.

7. Plans, trial and payment

You can start without an account, then try Qwox for 7 days without a card. The trial ends on its own; nothing is charged unless you subscribe. The paid plan is described on the Pricing page.

Subscriptions renew automatically each month or year until cancelled. Prices are in US dollars and may include or add taxes. If a price changes, we tell you at least 30 days before your next renewal, and you can cancel before it applies.

Fair use keeps the assistant fast for everyone. If you reach it, Qwox tells you, and it renews at the start of the next month.

8. Cancellation and refunds

You can cancel at any time. App Store and Google Play subscriptions are cancelled in your store settings. Web subscriptions are cancelled by writing to hey@qwox.ai from your account email; we cancel within one working day. Your plan stays active until the end of the period you paid for.

If you subscribed on the web, you can ask for a full refund within 14 days of your first payment. Other payments are not refunded for partial periods, except where the law requires. App Store and Google Play purchases follow their store’s refund rules.

If you are a consumer in the EU or UK, you have a 14-day right to withdraw from your first paid subscription; the refund above covers it.

Whether or not you subscribe, your records stay visible and downloadable after the trial or a cancellation.

9. Ending the agreement

You can stop at any time by deleting your account. We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or to protect others; where we can, we tell you first and give you time to download your records. If we stop offering Qwox, we will give at least 30 days’ notice and refund any prepaid unused period.

10. Our service

Qwox, its software, design and brand belong to QWOX LLC. We keep improving Qwox and may change features; we will not remove core functions of a paid plan during a period you paid for without notice and a fair refund.

11. Warranty and liability

To the extent the law allows, Qwox is provided “as is”, without warranties that it will be uninterrupted or error-free.

To the extent the law allows, QWOX LLC is not liable for indirect, incidental or consequential damages or lost data or profits, and its total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or 50 US dollars.

Nothing in these terms limits liability that cannot be limited by law, such as for fraud, gross negligence or intent, or your mandatory rights as a consumer where you live.

12. Law and disputes

These terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. Disputes go to the state or federal courts in Bernalillo County, New Mexico. If you are a consumer, you also keep the protection of the mandatory laws of your country and can bring a claim in your local courts.

Before going to court, please write to hey@qwox.ai so we can try to solve it within 30 days.

13. Changes to these terms

If we change these terms in a way that matters, we tell you in the app or by email at least 30 days before they apply. If you do not agree, you can cancel and delete your account before then.

14. General

These terms and the Privacy Policy are the whole agreement between us about Qwox. If a part is found invalid, the rest stays in force. We may transfer this agreement as part of a merger or sale of the business; you may not transfer it without our consent. The English version prevails where translations differ, unless the law where you live requires otherwise.
